These Terms and Conditions outline the rules and regulations for using our services. By accessing or using evSpot, you agree to comply with these Terms and Conditions. If you disagree with any part of these terms, please refrain from using our services.
1. INTRODUCTION
Welcome to evSpot. These Terms and Conditions ("Terms") govern your use of the evSpot platform, website, mobile applications, and services (collectively referred to as the "Service"). By accessing or using evSpot, you agree to comply with and be bound by these Terms.
evSpot provides a platform that enables property owners, homeowners, and property managers (collectively "Hosts") to list their EV charging spots for others ("Drivers") to rent. Our services facilitate the connection between Hosts and Drivers seeking convenient EV charging solutions.
2. USER ACCOUNTS
2.1 Registration Requirements
a. Users must provide accurate, current, and complete information when creating an account.
b. Users are responsible for maintaining the confidentiality of their account credentials.
c. Users must promptly update their account information to keep it accurate and current.
d. Users must be at least 18 years of age to create an account and use the Service.
2.2 Account Security
a. Users are solely responsible for all activities that occur under their account.
b. Users must immediately notify evSpot of any unauthorized use of their account or any other security breach.
c. evSpot reserves the right to terminate accounts or suspend access if we suspect unauthorized or fraudulent account activity.
3. PLATFORM SERVICES
3.1 Host Responsibilities
a. Hosts must ensure the accuracy of their charging spot listings, including location, availability, charging specifications, and pricing.
b. Hosts are responsible for maintaining their charging equipment in safe, functioning condition in compliance with all applicable laws and regulations.
c. Hosts must ensure they have the legal right to list and rent out their charging spots.
d. Hosts must comply with all local zoning, electrical, and safety regulations applicable to EV charging installations.
3.2 Driver Responsibilities
a. Drivers must use charging spots in accordance with any rules and guidelines specified by the Host.
b. Drivers are responsible for properly connecting and disconnecting their vehicles from charging equipment.
c. Drivers must vacate charging spots promptly after their reserved time or when charging is complete.
d. Drivers are responsible for any damage caused to the Host's property or charging equipment due to improper use.
3.3 Payment and Fees
a. evSpot facilitates payment transactions between Hosts and Drivers.
b. Pricing for charging sessions is set by Hosts and clearly displayed to Drivers before booking.
c. evSpot deducts a service fee from each transaction before crediting the Host's account.
d. All payments are processed through our secure payment provider and are subject to their terms and conditions.
e. Refunds may be issued in cases of service interruption or platform malfunction.
f. If payment collection fails, Hosts may receive compensation up to the pre-authorization hold amount to cover utility costs.
4. LIABILITY LIMITATIONS
4.1 Service Provided "As Is"
a. The Service is provided on an "as is" and "as available" basis without warranties of any kind.
b. evSpot does not guarantee that the Service will be uninterrupted, secure, or error-free.
4.2 Disclaimer of Warranties
a. evSpot disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
b. evSpot makes no warranties about the accuracy, reliability, completeness, or timeliness of the Service or Content.
4.3 Limitation of Liability
a. evSpot is not responsible for any damages, losses, or accidents that occur during the use of charging facilities or as a result of the rental transaction.
b. Users are responsible for their actions and interactions on the platform. evSpot does not assume liability for any disputes or disagreements between Hosts and Drivers.
c. In no event shall evSpot be liable for any indirect, incidental, special, consequential, or punitive damages.
d. evSpot's total liability to any user shall not exceed the amounts paid by the user to evSpot in the twelve months preceding the claim.
5. PROHIBITED CONDUCT
Users agree not to:
a. Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
b. Harass, abuse, or harm another person or entity through the Service.
c. Impersonate evSpot, an evSpot employee, or another user.
d. Attempt to gain unauthorized access to the Service or its related systems or networks.
e. Use the Service to transmit any viruses, malware, or other harmful computer code.
f. Interfere with or disrupt the Service or servers or networks connected to the Service.
g. Scrape, data-mine, or otherwise collect data from the Service without evSpot's written consent.
h. Use charging spots for any purpose other than EV charging without the Host's express permission.
6. DISPUTE RESOLUTION
6.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.
6.2 Arbitration
a. Any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that users may assert claims in small claims court if they qualify.
b. The arbitration will be conducted by the American Arbitration Association under its Commercial Arbitration Rules.
c. The arbitration shall take place in King County, Washington, unless otherwise agreed upon.
d. Each party will be responsible for paying their own arbitration fees, subject to applicable law.
6.3 Class Action Waiver
Users agree to resolve any disputes on an individual basis and waive any right to participate in a class action, class-wide arbitration, or representative action.
7. TERMINATION
7.1 Termination by evSpot
evSpot reserves the right to terminate or suspend user accounts, access to services, or the entire platform at any time without prior notice for any violation of these Terms or any unlawful activity.
7.2 Termination by User
Users may terminate their account at any time by contacting evSpot customer support.
7.3 Effect of Termination
Upon termination, user access to the Service will be immediately revoked. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. CHANGES TO TERMS
evSpot may modify these Terms at any time by posting the updated terms on our website. Continued use of the Service after such modifications constitutes acceptance of the updated Terms. Users will be notified of significant changes to these Terms through email or platform notifications.
